A cattleman embroiled in a legal battle to stop Parks Victoria from shooting feral horses in the Alpine National Park has lost his appeal.

The Supreme Court on Friday afternoon refused Philip Maguire’s application for leave to appeal a decision that allows Parks Victoria to send in shooters to cull brumbies under a management plan to protect native flora and fauna.

Mr Maguire’s legal team argued in their grounds-of-appeal submission that Parks Victoria failed to properly consult and undertake timely and inclusive engagement with the community about plans to shoot the horses.

The 2018-21 Feral Horse Strategic Action Plan noted on page 25 that “shooting will not be used to control free-ranging feral horses”.
