COMMERCIAL TERMS & CONDITIONS
- This order is designed to establish a rate for advertising discounted over consecutive months/editions.
- Equestrian Life will protect the agreed rate over the agreed period.
- Acceptance of the booking includes an irrevocable authority for Equestrian Life to repeat the current advertisement if no new copy has been received by the Closing Date of each issue or advertising period.
- Failure to complete the required booking term will result in all discounts in advertising rates to be re-invoiced by Equestrian Life and are to be paid in full.
- Payment of accounts will be made within trading terms.Terms are 14 days.
- Any signatory for a proprietary company application shall be personally liable for the due performance of the applicant’s obligations as if the signatory was the applicant.
- Quotes are valid for 28 days from the date noted on the Advertising Quotation / Booking Agreement.
- We reserve the right to re-publish your advertising in other media, including print and online media.
- The applicant/advertiser is liable for all out-of-pocket expenses and all other reasonable expenses including debt collection commission (as if the account had been collected) and any other contingent expenses and legal costs on a solicitor/own basis incurred by Equestrian Life for enforcement of obligations and recovery of moneys due from the applicant/customer to Equestrian Life.
- If no content is provided for online advertising, this agreement gives us authority to source content from your website.
- Equestrian Life does not guarantee the positioning of advertisements in the Magazine, and is not liable for failure to meet positioning requests.
- Cancellations must be made in writing and received at least 30 days before the campaign start date.
- Refunds for cancellations made within this period will be subject to a 20% cancellation fee.
- No refunds will be provided for cancellations made less than 14 days before the campaign start date.
- All Digital Display advertising must be booked 30 days before the start of a new campaign, this includes rebooking when a campaign is coming to an end. If a new contract rebooking the position is not signed before the 30-day period, the position will become available to other clients. Advertisers must provide 30 days written notice of cancellation.
Non-Exclusivity
This agreement does not grant the Client exclusive rights to advertise with Equestrian Life. Equestrian Life retains the right to offer similar advertising services to other clients, including competitors of the Client, without any obligation to inform the Client. The Client acknowledges that their advertisements may appear alongside those of other advertisers, including competitors.

18.1 Copyright
Material entered onto the Equestrian Life Network by us is © Equestrian Life. All rights reserved. Unless otherwise indicated on the Equestrian Life Network, the material on the Equestrian Life Network is owned by or licensed to Equestrian Life and is subject to copyright (“the Copyright Material”). You may:
- Only copy, download, print, or reproduce the Copyright Material for the purpose of browsing the Equestrian Life Network or for your own personal, private, or research use, provided that such use constitutes fair use under the Copyright Act.
- Not alter or modify the Copyright Material or remove any legal notice associated with it.
18.2 Trademarks
- equestrianlife.com.au and other names of Equestrian Life Pty Ltd’s products and/or services are our trademarks or registered trademarks. Other product and company names mentioned on the Equestrian Life Network may be the trademarks of their respective owners.
18.3 License
In consideration of us allowing you to access and use the Equestrian Life Network, you grant us a non-exclusive, payment-free, perpetual, irrevocable license to reproduce, modify, delete, adapt, and publish any material you post, upload, or otherwise transmit via Communications Tools and to sub-license the same for such purposes as we determine from time to time.
Privacy
The Equestrian Life Network is bound by the Privacy Act 1988 (Cth). Personal information held by us about you may include your name, address, email address, account password, and contact telephone number. We only collect personal information about you directly from you and from publicly available sources of information such as telephone directories.
You may be required to enter your credit card or other financial details when using the Equestrian Life Network for the purposes of processing payment. However, we are never able to access these details, as they are encrypted and sent directly to our banking service provider. We do not collect, hold, store, or have any ability to access your credit card or other financial details.
If you decline to provide certain personal information (such as your name and email address) you may not be able to register as a member of the Equestrian Life Network and will have limited access and usage rights.
When you visit the Equestrian Life Network or use the features available via the Equestrian Life Network, we may record anonymous information such as your IP address, time and date of visit, referring URL, pages accessed, documents or files downloaded, or the type of browser and/or operating system you used to access the Equestrian Life Network.
We may use Cookies to record your preferences, measure and assess usage of the Equestrian Life Network, and to ensure adequate security is afforded to users. You may adjust your browser settings in order to disable Cookies. If you disable your cookies browser setting we may not be able to provide you with the full range of our services via the Equestrian Life Network.
Where the Equestrian Life Network includes links to third-party sites, those sites may have different privacy policies. We recommend that you read the privacy policies of third-party sites before you disclose any personal information.
Your personal information may be used to verify your identity, assist you to become a member of the Equestrian Life Network, provide you with services including those provided by third parties, enable us to contact you in relation to services purchased by you and bill you for services you have purchased.
We do not and will not disclose your personal information to any third parties unless disclosure is permitted by you or these Terms and Conditions, required or authorized by law, or necessary to enable us to obtain relevant professional (legal or financial) advice.
You have a right to access and change your personal information, subject to law. We may request you to submit a written request to change your personal information.
Applicable Law
